How costs are calculated
The rates laid down by law are mentioned in a list of rates. As from what moment and until what moment in the procedure does the Dutch government recover the costs incurred from the carrier?
The Dutch government can recover costs incurred by the inadmissible person from the carrier from the moment the Royal Netherlands Marechaussee has issued a booking request for this person. These could be costs of applying for a replacement travel document or costs of escorts, for example.
The starting date for the calculation of cost of stay will be the date stated in the booking request as the desired date of return of the foreign national (see example).
Or, for the maritime sector:
You are hereby requested to transport the inadmissible person at the latest on ... [departure date of seagoing vessel] on the seagoing vessel ... [name seagoing vessel] from the Netherlands.
The end date for passing on any costs is the date* stated in the official notification of departure, as stated by the Royal Netherlands Marechaussee or the Dutch Police. This is usually the date on which the inadmissible person has left the Netherlands.
*Except the costs of an escort by the Royal Netherlands Marechaussee. These consist of costs incurred during the outward journey, stay and return journey of the escorts.
In case of a flight cancellation request
The Royal Netherlands Marechaussee uses a flight cancellation request to notify the carrier that the inadmissible person cannot (yet) depart at that time. Depending on the reason for the cancellation, any costs incurred after the cancellation request may be charged to the carrier.
In case of a reminder of a booking request that has already been sent: the costs which the Dutch government may recover from the carrier are charged from the date stated in the original booking request.
In case of an addition to a booking request that has already been sent: the Dutch government may recover costs incurred as from the date stated in the original booking request. This depends on the reason for the addition to the booking request.
In case of a change to a booking request that has already been sent: the Dutch government may recover costs incurred as from the date stated in the original booking request. This depends on the reason for the change to the booking request.
